Our Adoption Process in Washington

At Northwest Family Law, we guide families through every stage of adoption with clarity and care. While every adoption is unique, the process in Washington generally follows these steps:

1. Filing the Petition

Every adoption begins with a petition filed in Superior Court. The petition includes background checks, required consents, and, in most private adoptions, a home study.

2. Working with State Agencies (Foster-to-Adopt)

In foster-to-adopt cases, families work directly with the Department of Children, Youth, and Families (DCYF). Once a child is legally free for adoption, DCYF partners with families and attorneys to prepare the petition.

3. Private or Agency Adoptions

Private and agency adoptions often require additional steps, such as agency reports and counseling sessions. These steps provide the court with a full picture of the child’s needs and the family’s readiness.

4. The Court Hearing

Regardless of the adoption type, the final decision rests with the Superior Court judge. The judge reviews the petition, supporting documents, and testimony before issuing the adoption decree.

How Long Does Adoption Take in Washington State?

The length of the adoption process in Washington depends on the type of adoption and the circumstances of the case. On average, most adoptions take six months to a year from the time the petition is filed until the final hearing in Superior Court. S

Some cases may be completed more quickly, while others, especially those involving contested parental rights or complicated agency requirements, can take longer.

  • Foster-to-Adopt Cases: Once a child is legally free for adoption, finalization can often be completed in just a few months. However, the foster care stage leading up to that point may take a year or more.
  • Private or Agency Adoptions: These cases usually take longer, often between nine months and eighteen months, depending on home studies, background checks, and agency requirements.
  • Relative Adoptions: Grandparent, aunt/uncle, or step-parent adoptions are sometimes faster, especially if both biological parents consent, but they may still require several months of court review.
