3 Types of Minor Guardianship in Washington State

Here are the three types of minor guardianship:

  1. Emergency or temporary guardianship: A short-term order used when the child faces immediate risk and someone needs legal authority right away. Often used while a longer case is being prepared.
  1. Limited guardianship: The court grants authority over only specific areas, such as medical care, school enrollment, or where the child lives. Parents keep the rest of their rights.
  1. Full guardianship: Broad legal authority over the child’s daily life, and sometimes over money or property the child owns (called guardianship of the estate).

Relatives, family friends, and stepparents can ask the court for any of these. Parents have the right to be heard, and the court usually appoints a Guardian ad Litem, a neutral person who looks out for the child.

Frequently Asked Questions About Minor Guardianship in Bellevue, Washington

How long does a minor guardianship case usually take in Washington state?

Most minor guardianship cases in King County take roughly two to four months from filing to a final court order, though timing depends on whether parents can be reached, whether anyone objects, and the court’s hearing schedule. Simple, uncontested cases where everyone agrees move faster. 

Do I need a full court guardianship, or can a notarized letter or power of attorney work instead?

It depends on what you need to do for the child. A signed parental consent or short-term power of attorney can sometimes cover limited situations, like a single school year or a specific medical appointment, if the parents are available and willing to sign. But schools, hospitals, and government agencies often require a court-issued order called Letters of Guardianship before they will accept your authority long-term. 

Can a grandparent or aunt or uncle file for guardianship in Washington?

Yes. Washington law allows a grandparent, aunt, uncle, older sibling, or other trusted adult to ask the court to become a child’s legal guardian. The court’s focus is the child’s well-being, not your relationship label. You will need to show that guardianship serves the child’s best interests and that you can provide a safe, stable home. 

What happens if the child’s parents are overseas or cannot be reached?

This is more common than people think, and the court has procedures for it. You still need to give the parents notice of the case, but if they are unreachable after a real effort, the court can move forward without their direct participation. If parents are abroad and willing to sign documents, their written consent can often be submitted from another country with proper formatting. 

Will the court take the child away from me during this process?

No. A minor guardianship case is a civil, protective process. It is not a child welfare investigation, and it is not the government stepping in to remove a child. A judge’s job here is to confirm the child is safe and that guardianship serves their best interests, then issue an order that gives you the legal authority you need.

What is a Guardian ad Litem, and will one be involved in my case?

A Guardian ad Litem, often called a GAL, is a neutral person the court can appoint to look into the child’s situation and report back to the judge. They may speak with you, the child, the parents if reachable, and sometimes the child’s school or doctor. Not every case requires a GAL, but when one is appointed, their role is to help the judge understand what is best for the child. 

Can the parents take guardianship back later?

Yes, guardianship is not permanent in the way adoption is. If a parent’s circumstances change and they are able to safely resume care, they can ask the court to end the guardianship. The court will look at whether returning the child to the parent serves the child’s best interests at that time. 

What is the difference between guardianship and adoption in Washington?

Adoption permanently ends the legal relationship between a child and their birth parents and creates a new permanent parent-child relationship. Guardianship gives you legal authority to care for and make decisions for a child without ending the parents’ legal rights. For many extended family caregivers, guardianship is the better fit because it formalizes care without cutting parents out of the child’s legal family. 

What ongoing responsibilities does a legal guardian have after the court order is entered?

You have legal authority to enroll the child in school, consent to medical care, and handle most day-to-day decisions. Washington also requires guardians to file periodic reports with the court about the child’s well-being and, in some cases, their finances. These reports are usually short and straightforward, and we help our clients stay on top of them so nothing falls through the cracks.
