How Long Does Spousal Maintenance Last in Washington?

In Washington, spousal maintenance duration often depends on the length of the marriage, but there is no fixed formula. A general pattern is:

  • Short-term marriages, under 5 years: Courts may award little or no maintenance and often aim to return both spouses to their pre-marriage financial position.
  • Mid-length marriages, 5 to 25 years: Maintenance is often temporary or rehabilitative, giving the receiving spouse time to pursue education, training, or workforce re-entry.
  • Long-term marriages, 25+ years: Courts may award longer-term or indefinite maintenance, especially when one spouse cannot reasonably become self-supporting.

What is the difference between spousal maintenance and spousal support in Washington?

In Washington, the two terms mean the same thing. The state statute uses “maintenance,” while “spousal support” and “alimony” are the everyday words people use. Whatever you call it, the legal framework under RCW 26.09.090 is identical.

Is spousal maintenance taxable in Washington State?

For divorces finalized after December 31, 2018, spousal maintenance is no longer deductible for the paying spouse or taxable income for the receiving spouse under federal law. Washington has no state income tax, so there is no state-level tax issue. Orders entered before 2019 still follow the old tax rules unless modified in a way that triggers the new ones.

Can spousal support be waived before or during marriage in Washington?

Yes. Couples can waive or limit maintenance through a valid prenuptial or postnuptial agreement, as long as the agreement is fair, fully disclosed, and signed voluntarily. Courts will scrutinize these agreements closely, especially if one spouse would be left in financial hardship. 

What triggers a modification to a spousal maintenance order?

A modification generally requires a substantial change in circumstances since the last order. Common triggers include job loss, serious illness, retirement, a significant raise, or the recipient becoming self-supporting. Post-decree filings, including motions to modify or terminate maintenance, make up a significant share of Superior Court activity, which shows how often life changes bring people back to court.

Does remarriage end spousal maintenance in Washington?

Yes. Under RCW 26.09.170, maintenance automatically terminates when the receiving spouse remarries, unless the divorce decree specifically says otherwise. Cohabitation alone does not automatically end maintenance, but it can be grounds to request a modification.
